  1. Purposes of the processing of personal data:

The personal data we collect from you, we will use them for the following purposes that are necessary for the service you request:

  • Identify the legal representative or the Data Subject and confirm that he/she has the authority to be bound in terms of the contractual relationship between the company he/she represents and the Data Controller or between the Data Subject and the Data Controller, as the case may be.
  • To enter into the corresponding contracts for the formalization of the Responsible’s services, as well as the necessary accessory legal instruments.
  • Comply with the internal policies of the person in charge
  • To register you in the Responsible’s records.
  • To carry out the activities that are necessary for the provision of our services and to comply with the contract between the company it represents and the Controller or between the Data Subject and the Controller, as appropriate.
  • Use them in any type of judicial and/or extrajudicial collection act or proceeding.
  • Comply with the contractual obligations that the Controller has with the Data Controller.
  • To elaborate statistics and reports of the services rendered by the Controller in order to keep an internal control of such services as well as to provide timely follow-up of the same.

In addition, we will use your personal information for the following purposes that are not necessary for the requested service, but that allow us and facilitate a better service:

  1. To offer you new products or services of the Responsible or companies that are part of the group to which the Responsible belongs.
  2. That the Responsible uses them for purposes of participation in current or future private or governmental programs for the benefit of the companies.

The refusal to use your personal data for these secondary purposes may not be a reason for us to deny you the services and products you request or contract with us.
You as the Data Subject have a period of five (5) business days to express your refusal for the processing of your personal data with respect to the secondary purposes, as the case may be. The rights of you as the Data Subject, to exercise your rights of revocation of consent or opposition, in case you do not express your refusal to the processing of your personal data prior to the delivery of the same or its use, remain unaffected.

  1. Personal data we collect:

For the aforementioned purposes, we may collect your personal data in different ways: when you provide it to us directly, or by obtaining it indirectly, through other sources that are permitted by the Law and the Regulations.

We collect your personal data directly when you provide it to us in person, by filling out a printed form, by e-mail, through an online form, or by telephone. The data we collect by these means are personal identification and contact data. The personal data that may be collected are the following: Full name, Address, Age, Gender, Telephone and Mobile, E-mail, Nationality, Date and Place of Birth, Degree of Studies and Institutions where they were obtained, Work experience, professional license number, Social Security number, available office hours.

  1. Sensitive personal, financial and patrimonial data that we collect:

The Responsible also collects, from certain individuals and for some specific processes sensitive personal, financial and patrimonial data. The personal data of this nature that may be collected are the following: Federal Taxpayers Registry, Photograph (in some cases when the Curriculum Vitae sent contains it), Birth Certificate, Unique Key of Population Registry, Voting Credential, Military ID, Proof of Address, Letter of Recommendation, IMSS Affiliation, Letter of Non-criminal Record and Credit Record.
These data may be collected from the holder through any of the aforementioned means.
In accordance with the provisions of Article 9 of the Federal Law on Protection of Personal Data Held by Private Parties, when the Responsible Party collects such data from you, you will be required to give your express consent for the processing of this data, so we will ask you, at the time, to indicate whether or not you accept the treatment, and if you accept it, provide us with this document duly signed.

  1. Transfers of personal data within Mexico and abroad:

Your personal data may be transferred and processed within and outside the country, to authorities and controlling companies, subsidiaries and/or affiliates of the Group to which the Responsible Party belongs. The aforementioned transfers will be carried out as follows:

Regarding national or international transfers, the Receiver will assume the same obligations that correspond to the Controller who transferred the personal data and therefore, the Controller is obliged to communicate to the Receiver the conditions under which the Data Subject consented to the processing of his/her personal data. We undertake not to transfer your personal information to third parties without your consent, except for the exceptions set forth in article 37 of the Federal Law for the Protection of Personal Data in Possession of Individuals, as well as to carry out this transfer under the terms set forth in that Law.

7. Means to exercise the rights of Access, Rectification, Cancellation or Opposition (ARCO):

You have the right to know and access your personal data that we have and the details of its processing (Access); as well as to rectify them if they are inaccurate or outdated and/or incomplete (Rectification); to request that they be deleted from our records or databases when you consider that they are not being used in accordance with the principles, duties and obligations provided for in the regulations (Cancellation); or oppose their processing for specific purposes (Opposition). These rights are known as ARCO rights. The mechanisms that have been implemented for the exercise of said rights are through the presentation of the respective request to our person Responsible for Personal Data, either personally at the same address or by sending an email to the person previously indicated. Said request must contain at least: i) full name of the Owner, address or any other means of contacting him/her; ii) simple copy of official identification (voter ID, license or passport) or the public instrument through which the legal representation of the Holder is accredited; iii) the express indication of the ARCO right that you wish to exercise; iv) the clear and precise description of the personal data with respect to which one seeks to exercise any of the aforementioned rights; v) any other element that facilitates the location of personal data. In case of exercising the right of Rectification, the Owner must additionally include: the modifications to be made and the documentation that supports said request.

Please bear in mind that the Responsible Party has by Law a period of twenty (20) days from the date of receipt of the request, to communicate to the Owner the determination adopted so that, if appropriate, it is made effective within fifteen (15) days following the date on which the response is communicated. The Controller may contact the Owner personally or in writing at his address or through the means that the Owner has indicated in his request.   1. Mechanisms and procedures for the owner, if applicable, to revoke his or her consent at any time:

You as the Owner can revoke the consent that, if applicable, you have given us for the processing of your personal data. However, it is important that you keep in mind that not in all cases we can respond to your request or terminate the use immediately, since it is possible that due to some legal obligation we require to continue processing your personal data. Likewise, you must consider that for certain purposes, the revocation of your consent will mean that we will not be able to continue providing the service you requested from us or the conclusion of your relationship with us.
To revoke your consent, you must submit your request to our person responsible for Personal Data at the address established in point 2 of this Privacy Notice, or send it by email.
